These Booking Conditions are agreed between Kisla Falls and you as the holiday maker. “We”, “us” or “our” are references to Kisla Falls. “You” or “your” are references to the person making the booking on behalf of the holiday party and all members of the holiday party as are confirmed at the time of booking. No other person may be a member of the holiday party nor may they stay at Kisla Falls at any time during the period of booking. Any booking is subject to the conditions below. These Booking Conditions form the basis of your contract with us so please do read them carefully. Nothing in these Booking Conditions affects your normal statutory rights. These Booking Conditions, together with the Quote, the Cancellation Policy and our confirmation email contain the entire agreement between us and you relating to the Booking and supersedes any previous agreements, arrangements or discussions.
Accuracy at point of sale - the information and descriptions supplied regarding Kisla Falls are believed to be accurate and offered in good faith. Some changes during your stay may be dictated by local circumstances, necessity for maintenance or repair (eg: swimming pools), unfavourable weather conditions, fuel shortages, power cuts or other circumstances beyond Kisla Falls’ control. If Kisla Falls is advised of any such issues, we will endeavour to inform you in advance, however Kisla Falls cannot be held liable in such circumstances.
Amendments to our Booking Terms & Conditions - We reserve the right to amend, add or withdraw any of our booking terms and conditions at any time and without notice.
Arrival and departure time - you may arrive at Kisla Falls after the time specified by us on the Arrival Date for your holiday and you must leave by the time specified by us on the Departure Date. Unless otherwise specified, the arrival time is 16:00 on the Arrival Date and the departure time is 11:00 on the Departure Date. This allows time for the villa to be cleaned after and before your stay for other guests. Please bear these times in mind when booking your flights. Some flexibility with these times may be possible, subject to availability and in some cases, at additional cost, however, this would be at the discretion of Kisla Falls and must be by prior arrangement. Local beach clubs and hotels have facilities for the day should you need somewhere to stay awaiting a late flight. If your arrival is delayed, you must inform us immediately so that alternative arrangements may be made. If you fail to do so you may not be able to gain access to Kisla Falls. If you fail to arrive by noon on the day after the Arrival Date and you have not advised us of your anticipated late arrival, we may treat the Booking as having been cancelled by you and we shall be under no obligation to refund you for fees already paid to us.
Cancellations - We acknowledge that sometimes a cancellation is unavoidable. We strongly recommend you take out travel insurance before you travel as we cannot be held responsible for any personal injury or loss/damage/theft of guests personal belongings whilst staying at the apartment. In the event of a cancellation of any kind we regret that you will lose the non-refundable reservation payment regardless of when you cancel. If you cancel up to 12 weeks before your arrival date, the reservation payment is retained by us and is not refunded. You do not have to pay any of the booking cost. If you cancel less than 8 weeks before arrival, we will retain the reservation payment plus 50% of the total cost paid at that time. You are not required to pay the remaining 50% of the total cost and we will refund 50% of what you have paid by then. If the booking is cancelled in the eight week period before your arrival date, we will retain all payments made by then being the reservation payment and the full payment of booking cost. At our discretion we may be able to offer a refund if an alternative guest can be found for your dates, and provided this has been at no loss or cost to us.
Complaints- We sincerely hope your holiday arrangements run as smoothly as possible and you enjoy your time at Kisla Falls. However, if you do feel the need to complain, we recommend that you immediately inform the agent or contact us directly at kislafalls@gmail.com. It is often extremely difficult (and sometimes impossible) to resolve issues unless we are promptly notified. Discussion with us whilst you are in residence at Kisla Falls will usually enable any problems to be resolved promptly and to satisfaction. In particular, complaints of a transient nature (for example, regarding preparation of Kisla Falls or equipment malfunction) cannot possibly be investigated unless registered whilst you are in residence. If you fail to follow this procedure there will be less opportunity to investigate and rectify your complaint to your satisfaction during your stay. If you are still not satisfied, you must put your complaints in writing immediately on return to the UK (or at the very least within 28 days of your return) to kislafalls@gmail.com. Kisla Falls shall be entitled to a reasonable period of time within which to investigate any written complaint received from you and to respond thereto before any arbitration or other legal proceedings are initiated by or on your behalf.
Confirmation of your booking Immediately upon receipt of the holiday confirmation from Kisla Falls, you must check the details and notify Kisla Falls of any mistakes/errors made by Kisla Falls as soon as possible and in any event within 7 days; no changes can be made to the booking after this time. Kisla Falls reserves the right to charge a £20 amendment fee to administer/correct any error by you. Any request for changes to be made must be in writing from the person who made the booking (the lead guest).
Contract - These terms and conditions (together with the other information on our website and social media form part of the contract between the person making the booking, acting on behalf of everyone named on the booking form (hereinafter called 'you') and Kisla Falls or local agent. The contract between you and Kisla Falls exists when Kisla Falls issues your holiday confirmation and is in receipt of your initial payment. All arrangements are made subject to the following terms and conditions. By making a booking with us via email, our website, our online booking form, by telephone or in person, you agree to be bound by these terms and conditions.
Damage deposit - The Damage Deposit may be used for any repair and/or replacement of Kisla Falls, furnishings, fixtures and fittings that are necessary after your stay. Any damage liability rests totally with you. If any damage occurs (accidental, wilful, reckless or otherwise) or if Kisla Falls is left in an unacceptable condition, then the resolution of any dispute shall be between you and Kisla Falls. The payment of your security deposit does in no way exclude you from your responsibility to take every care of your holiday accommodation. Kisla Falls will be presented in good order and should be left as such. Should no damage have occurred during your stay then the breakage deposit will be returned to you. Additional payment for any proven claim in excess of the breakage deposit will be requested by Kisla Falls directly from you. We have the right to invoice you the balance for all breakages, damages or losses in the event that these costs exceed the Security Deposit. If no deductions are required, the Damage Deposit (or the balance, if deductions have been made) will be returned to you within 28 days of the end of your holiday. Any Other Fee(s) shall be described in the Quote and are non-refundable.
Data protection and privacy - Kisla Falls’ relationship with you is valuable and we understand the importance you place on your privacy and the security of any information which personally identifies you. Kisla Falls' privacy policy shall be deemed to be incorporated into these booking terms conditions. Contact and other information essential to manage bookings is kept electronically and may be passed to the authorized agent for booking and management purposes only. You consent to this by placing a booking. We commit to keeping any information we obtain from you in a secure environment. With the exception of passing identity information to the relevant Turkish authorities for the purpose of complying with local legislation, we never share your data with anyone outside the business and we never collect data about you automatically on our website. We retain your data only as long as necessary for tax and insurance purposes or to fulfil legislative requirements. We do not store any bank or passport details. Force Majeure - No liability can be accepted by Kisla Falls when the contract is affected by force majeure. In the context of these terms and conditions 'force majeure' is any event that we could not, even with due care, foresee or avoid. These events include, but are not limited to; war, threat of war, riot, civil commotion or strife, hostilities, industrial dispute, natural disasters, acts of god, terrorist activity, threat of terrorist activity, adverse weather conditions, airport closure, government action, changes to Foreign & Commonwealth Office travel advice, technical problems with transportation or any other events beyond Kisla Falls’s control.
Help on Holiday - If you need assistance whilst at Kisla Falls, in the first instance, you should contact the local agent will be more than happy to assist you in any way they can. Relevant contact details will be provided on your travel documents. If you cannot contact Kisla Falls or our agent in the case of an emergency, please do not hesitate to contact us at kislafalls@gamil.com
Indemnity by you for your party - when you book accommodation through Kisla Falls you accept responsibility for any damage to Kisla Falls or accommodation and its contents caused by you or a member of your party. Kisla Falls reserves the right to terminate (before or after departure) your holiday or that of any member of your party due to your or their misconduct, within our reasonable opinion. In these circumstances full cancellation charges apply and no refund will be given. Furthermore, we shall be under no obligation to pay compensation or meet any costs or expenses you may incur as a result of your accommodation being terminated. You agree to indemnify us against any claims (including legal costs) made against us. You are also liable to make reimbursement to the accommodation provider for any damage caused, before you end your stay.
Inventory- a detailed inventory of all items situated at Kisla Falls is attached. You agree not remove any items listed on the inventory. In the event any items are removed an allowance for brand new replacement cost plus £1- as an inconvenience charge per item will be deducted from the damage deposit before the balance is refunded to you.
Keys You will be provided with one set of keys to Kisla Falls. You agree to leave those keys in the safety deposit box by the front door on departure. If keys are taken on your departure from Kisla Falls, we will deduct the sum of £100.00 from the Security Deposit to cover the cost of replacement keys and/or locks. The code to the deposit box will be provided on arrival.
Liability - yours - your (and all other members of your party’s) personal belongings and vehicles (together with their contents) are left at the rental property entirely at their own risk. Kisla Falls shall not accept any liability for any loss or damage to your (and all other members of your party’s) personal belongings and vehicles (including their contents) during your holiday.
Liability - ours -Our maximum liability for losses you suffer as a result of us acting in breach of these terms and conditions is strictly limited to the total fees you have paid for the Booking. We shall not be liable for any losses which are not a foreseeable consequence of us breaking these Booking Conditions. Losses are foreseeable where they could be contemplated by you and us at the time your Booking is confirmed by us. Your Booking is made as a consumer for the purpose of a holiday and you acknowledge that we shall not be liable for any business losses howsoever suffered or incurred by you. We shall not be liable to you for any personal injury or damage to or loss of personal property, except where the injury, damage or loss is caused by our negligence. This does not exclude or limit in any way our liability for death or personal injury caused by our negligence or for fraudulent misrepresentation; or for any matter for which it would be illegal for us to exclude or limit, or attempt to exclude or limit, our liability. Kisla Falls accepts no liability whatsoever for any aspect of the arrangements and in particular, accepts no liability for any loss, personal injury/illness or death however incurred. Kisla Falls shall not accept liability for loss of main services such as electricity or water supplies, nor any actions taken in the vicinity of Kisla Falls by any authority over which there is no control. Refunds or compensation would not be payable and cancellation charges would still apply.
Law - The contract between you and us is governed by the law of England and Wales and we both agree that any dispute, matter or other issue which arises between us shall be dealt with by the Courts of England and Wales. Information held therein is believed to be correct at the time of writing.
Lead Guest - The lead guest is the person or agency that holds the booking, to whom all correspondence and invoices are addressed and who is responsible for the rental. Spouse's names are not considered interchangeable. Where two or more people are included in the same booking, the person making the booking shall be deemed to accept terms and conditions on the basis that he/she acts as an agent for all members of the party and accepts these booking conditions on behalf of each member of the party.
Misbehaviour - We reserve the right to terminate, without notice, the arrangements of any customer whose behaviour, in our opinion, is likely to cause annoyance, distress or danger to any third party. If you are prevented from travelling because you appear to any person in authority to be unfit to travel, or likely to cause discomfort or disturbance to other customers, our responsibility will cease. Full charges will apply and we will be under no obligation to provide a refund, compensation, or any further assistance. Parents/guardians are responsible for the supervision/behaviour of young children and teenagers.
Out of ‘Season’ bookings - The ‘Season’ in Kalkan runs from mid-May to end October. During this time building and construction work is prohibited in Kalkan, but work of a quieter nature may still occur in May. If you wish to make a booking outside of these dates, it is possible that construction projects may be going on in the area. Kisla Falls cannot be expected to know about all building projects in Kalkan and so bookings outside the ‘season’ cannot be guaranteed to be unaffected by construction works.
Payment terms -The total cost is payable in 2 stages. The non refundable reservation payment is taken to secure your dates. The balance is paid 12 weeks before your arrival date plus £300 for a refundable damage deposit of £300. The damage deposit will be refunded within 28 days after your departure subject to confirmation of no breakages etc.
Price - what’s included. Use of Kisla Falls, as booked for the people named on the booking form, including utilities and facilities which are advertised in the villa description as being available at no extra cost, plus the services of the local agent where applicable. What the price does not include - Security/damage deposits, en-route hotels, short and long sea crossings, flights, car hire, transfers, car parking, taxis, visa, excursions, food, beverage and holiday insurance are not included in the price.
Price Guarantee - Prices on the website do change from time to time; prices go up as well as down and you will be able to determine your up to date price for your chosen accommodation prior to confirming your booking. We guarantee that once you have made your booking, we will not increase the price of your accommodation. Please note that once you have agreed a price and made your booking this is the price you pay. If the price decreases, you are not entitled to the accommodation at the changed rate.
Reservation payment - This is20% of the total villa cost and is paid by you on booking in order to secure your chosen dates. It is non refundable. In the event of a cancellation of any kind you will lose the non-refundable reservation payment regardless of when you cancel. This payment has been paid to secure your dates which could be available to other guests, also interested in those dates. It also covers our time and inconvenience of having to find other guests to take those dates. We also may not get an exact match on dates, or the same price.
Safety - Please be as vigilant as you would be at home and ensure you take sensible precautions to protect your belongings - do not leave valuables or keys in sight of windows and do not leave doors or windows open when away from Kisla Falls or at night. You must accept responsibility for the behaviour and welfare of any children in your party. Every effort is made to ensure safety in Kisla Falls, however, any children staying at Kisla Falls do so at your risk. Use of the swimming pool is entirely at your risk. The pool is not gated or fenced. We accept no responsibility for damage or injury to any persons using the swimming pool at Kisla Falls. You agree to take care within Kisla Falls and gardens and consider the risks posed by balconies and the swimming pool to children. Swimming pool should be accessed by the steps and not by jumping or diving in. Please supervise children at all times in and around the pool. Care should be taken on the travertine marble flooring outside Kisla Falls and on the marble flooring inside Kisla Falls. Such flooring can be hazardous when wet.
Smoking - You shall not smoke within Kisla Falls. Smoking is permitted outside of the external walls of Kisla Falls but an ashtray must be used at all times and all cigarettes must be fully extinguished in the ashtray after use. In the event that the smoking policy is breached. We will levy a charge for laundry and additional cleaning of Kisla Falls in the sum of £200.00, this will be deducted from the Security Deposit.
Third party Bookings (airport Transfers, Car Hire, Gulet Trips + Excursions) - For all such bookings, your contract will be with the supplier of the arrangements concerned. The suppliers' terms and conditions will apply to your contract. Copies of these terms and conditions will be made available upon request. We have no liability for any transfer, car hire, Gulet trip or excursion arrangement and in particular any liability for illness, personal injury, death or loss of any kind. Any claims for damages, injury, illness or death arising from these services must be brought against the supplier concerned and will be under the jurisdiction of the law of the country in which the service is provided.
Transfer of booking you may not transfer your Booking or any rights and responsibilities under these Booking Conditions to any other person, without our prior written consent. If, at any time, any part of these Booking Conditions is held to be unenforceable for any reason under any applicable law, that part shall be deemed omitted and the enforceability of the remaining parts shall not in any way be affected by that omission.
Visas travel insurance - It is your responsibility to ensure that: any specific passport, visa and health requirements are obtained, Turkish visas must be obtained prior to travel. This is the link to the government portal https://www.evisa.gov.tr/en. All members of your party, including infants, have a valid passport within 6 months of expiry from your departure date. Each member of your party is covered by adequate travel insurance to cover all aspects of your holiday (including cover for cancellation, curtailment, evacuation, flight delays, loss and damage to baggage and other personal property as well as comprehensive health insurance including medical expenses and repatriation coverage). If you fail to take out adequate insurance cover, we will not be liable for any refunds or losses, howsoever arising, in respect of which insurance cover would otherwise have been available.
Your obligations - during the period of the holiday, you (personally and on behalf of all other people visiting Kisla Falls) undertake (for the benefit of Kisla Falls and Kisla Falls) as follows:
• to arrive after the designated check in time on the arrival day and to vacate Kisla Falls by the designated check out time on the day of departure unless prior arrangements have been agreed with Kisla Falls and/or the holiday confirmation states otherwise.
• that the number of people occupying Kisla Falls will not exceed the number stated on the booking. You may not significantly change the makeup of the party during your stay in Kisla Falls. If you do so, we may refuse to hand over Kisla Falls to you, or may require you to leave it. We shall treat any of these circumstances as a cancellation of the Booking by you, in which case we shall be under no obligation to refund you for fees already paid to us.
• not allow any person other than guests booked and staying in Kisla Falls for their holiday to use the facilities and amenities of Kisla Falls.
• that Kisla Falls will be used solely for the purpose of the holiday by you and your party.
• to show due consideration for other third parties (to include, but not limited to, refraining from abuses of Kisla Falls and/or dangerous, offensive or rude behaviour to Kisla Falls our representative or any third parties such as neighbours).
• to have consideration for other third parties and neighbours. This includes avoiding making excessive noise. If in our reasonable opinion or in the reasonable opinion of any other person in authority, You or any member of your party behaves in such a way as to cause or be likely to cause damage, upset, offence or distress to any third party or damage to Kisla Falls, or in any way damage the reputation and/or goodwill of Kisla Falls, We will be entitled, without prior notice, to terminate the occupation of the persons(s) concerned. In this situation, the person(s) will be required to leave Kisla Falls immediately. We will have no further responsibility to such person(s). No refunds will be made and We will not pay any expenses or costs incurred as a result of such termination.
• to keep and leave Kisla Falls and the decorations and furnishings, including items such as kitchen equipment, crockery and glasses clean and in good condition and you agree not to remove any such items from their original location.
• to not remove any items listed on the inventory.
• to report as soon as possible to Kisla Falls (or our agent) any breakages or damage caused by you or any of your party members during the holiday and to reimburse Kisla Falls with the cost of replacement if the amount in question exceeds the amount we hold as a security/damage deposit.
• to not cause any damage to the walls, doors, windows or any other part of Kisla Falls nor to do anything that may be reasonably considered to cause a nuisance or annoyance to us or to any other occupier of adjoining or neighbouring properties
• to ensure that at the end of the holiday Kisla Falls is left in the same state of order and cleanliness in which it was found. Kisla Falls reserves the right to charge you for any additional losses that are not covered by the security/damage deposit.
• all members of your party are aware that Kisla Falls reserves the right to make a claim against you for any repair or loss as a result of damage caused.
• to notify all other members of the party of these undertakings.
• in the event of a breach of any of the undertakings set out, Kisla Falls (or our representative) can refuse to allow you to take possession of Kisla Falls or make you and your party leave Kisla Falls before the end of the holiday. In either case, you shall be deemed to have cancelled the booking and you shall have no claim for compensation or reimbursement whatsoever.
• to take all necessary steps to safeguard your personal property and possessions
• to take care to secure Kisla Falls at all times and take care of the keys.
• To not allow any animal(s) to enter Kisla Falls. Stray animals need feeding after you have left and there will be no one to feed them. Guide dogs are allowed with advance notice.
• to ensure that each member of your party is covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage)
• to allow us (or any representative of Kisla Falls) access to Kisla Falls at any reasonable time during your stay for the purpose of essential repairs or in an emergency.
